第三章 工程造价的确定
第八条 建筑工程的投资估算、概算、施工图预算、工程最高限价、竣工结算、决算应当由具有编制能力的发包人或承包人编制，或者由其委托的具有相应资质的工程造价咨询企业编制。
招标标底和工程量清单由具有编制招标文件能力的发包人或者其委托具有相应资质的工程造价咨询企业、招标代理企业编制。投标报价由投标人或者其委托具有相应资质的工程造价咨询企业编制。

第九条 施工图预算、招标标底价、投标报价、竣工结算和工程最高限价由成本、利润、规费和税金构成，其编制可以采用下列计价方法。
(一)工料单价法，是指以分部分项工程量的单价为直接费。直接费以人工、材料、机械的消耗量及其相应价格确定。间接费、利润、税金按照有关规定另行计算。
(二)综合单价法，是指分部分项工程量的单价为全费用单价。
招标工程应当在招标文件中明确所采用的计价方法。
第十条 确定建筑工程造价，应当执行国家和本省制定的工程量计算规则、建筑工程项目划分规则和计价办法，并参考建筑工程投资估算和概算指标、建筑工程消耗量定额、建筑工程费用标准、建筑工程有关的材料、人工、机械台班价格等市场价格信息等;
招标标底、工程最高限价还应当依据招标文件、施工设计图纸、建设工程工程量清单计价规范、施工现场情况编制。
第十一条 建筑工程发包单位不得迫使承包方以低于成本的价格竞标。

第十二条 招标工程的合同价款由承发包双方根据招标文件和中标通知书中的中标价格在建筑工程施工合同中约定。
不实行招标投标的工程合同价款，在承包方编制的施工图预算基础上，由承发包双方协商在建筑工程
