事实与理由：
原告本人多年使用被告设计、开发的网络浏览器软件“360安全浏览器”，并通过了上述浏览器制作各种文书，欣赏视听资料等等，该软件确实为原告提供了网页浏览的便利，又因名为安全浏览器，故从未有过任何质疑。
2012年11月23日，原告正是通过“360安全浏览器”浏览新闻时，看到中国科学院信息工程保密技术攻防重点实验室撰写的一份《个人隐私泄露风险的技术研究报告》这一则新闻，关键内容为“360浏览器在架构设计、运作原理方面存在三大隐私安全隐患，会给用户安全带来严重危害”，该新闻又经中科院信息工程研究所主要负责人在翌日的新闻中证实，令原告在使用360安全浏览器中存在不安，鉴于原告有使用该软件的经历，有理由相信本人的隐私权已经遭到被告的侵犯。
