从中赚取利息差，造成被吸收的公众存款523700元无法归还的严重后果，应以非法吸收公众存款罪对被告人林金杯追究刑事责任。
被告人林金杯辩称：其行为属于合法的民间借贷行为，所借款项利率均未超过国家规定的限度，也没有赚取利息差，不能以非法吸收公众存款罪论处。
经审理查明：2000年1月至2001年1月，%-%不等月息的方法，向林世荣、黄鸿恩、陈琴英等10人借款，共计332100元。其中，2000年1月17日向林世荣借款5000元，约定月息2%；同年3月27日向黄鸿恩借款4万元，约定每月支付利息800元；同年6月29日和10月4日，分二次向陈琴英借款1万元和50800元，%；同年8月4日、8月19日、8月21日、10月4日、11月20日和12月19日，分别向林国明借款7000元、23000元、23000元、11800元、6200元及5900元，%；同年8月20日、27日，二次各向林益凤借款5000元，约定月息2%；同年9月7日、25日，二次向林国友借款5000元和1万元，%；同年11月29日向林金洪借款5000元，%；同年12月4日向林燕飞借款5万元，%；同年12月17

日向林金桂借款51000元，%；2001年1月30日向林建通借款18400元，%。因承包工程的工程款被部分拖欠、出借资金部分无法收回等原因，被告人林金杯除支付黄鸿恩三个月利息、于2003年3月28日归还林建通借款18400元、于2003年4月10日归还林燕飞借款5万元外，其余借款本息均未归还。2003年4月28日，公安机关决定对林金杯涉嫌非法吸收公众存款罪立案侦查。2004年8月24日，被告人林金杯被公安机关抓获。
上述事实有下列证据证明：
1、被告人林金杯的供述，证明其为了承包工程、%-3%不等月息的方式向林世荣、黄鸿恩、陈琴英等人借款，因为其出借给许清平、蔡文栋、林玉泉等人的借款未能收回而无法归还向林世荣、黄鸿恩、陈琴英等人所借的款项。
2、林世荣的陈述，以及被告人林金杯出具的借条一份，证明其与被告人林金杯系同学关系；被告林金杯承包过工程、盐场，也有在村里吸收村民的存款，放贷给他人；
