第十二条 新建项目的建设单位在房屋销售前，根据本条例规定，提出物业管理区域划分方案，报街道办事处或者乡镇人民政府及物业管理行政主管部门备案；在房屋销售时，应当将物业管理区域划分情况作为房屋买卖合同的内容。
已投入使用但尚未划分物业管理区域的，由物业管理行政主管部门会同街道办事处、乡镇人民政府确定物业管理区域的划分方案。
第十三条 一个物业管理区域成立一个业主大会。但是，只有一个业主的，或者业主人数较少且经全体业主一致同意，决定不成立业主大会的，由业主共同履行业主大会、业主委员会职责。

符合下列条件之一的，应当在物业所在地的县（市、区）物业管理行政主管部门、街道办事处、乡镇人民政府的指导协助下，召开首次业主大会：
（一）房屋出售并交付使用的建筑面积达到百分之五十以上；
（二）业主已入住户数的比例达到百分之五十以上；
（三）首套房屋出售并交付使用已满二年的。
第十四条 符合成立业主大会条件的，县（市、区）物业管理行政主管部门、街道办事处、乡镇人民政府应当在收到建设单位或者业主五人以上公开联名，提出筹备业主大会书面申请后六十日内，组织成立首次业主大会筹备组。
筹备召开首次业主大会所需费用由建设单位承担。
第十五条 首次业主大会筹备组由业主、建设单位、物业服务企业、街道办事处或者乡镇人民政府、社区居民委员会等派员组成。筹备组中的业主代表由街道办事处或者乡镇人民政府组织业主推荐产生。
业主大会筹备组人数应当为单数，其中业主所占比例不得低于筹备组总人数的二分之一。筹备组组长由街道办事处或者乡镇人民政府代表担任。
业主大会筹备组应当自成立之日起七日内，将成员名单在物业管理区域内进行公示。业主对筹备组成员有异议的，由街道办事处或者乡镇人民政府协调解决。
