〕所属的环境监察机构，负责本行政区域内环境保护情况的监督检查，对环境污染事故和纠纷进行调查、提出处理意见，并负责征收排污费。环保部门可以在法定权限范围内委托其所属的环境监察机构实施行政处分和行政强制措施。
环保部门应当建立检举、控告制度，公布投诉电话。对属于环保部门职责范围的检举和控告，应当依法处理；对属于其他管理部门职责范围的检举和控告，应当按照规定转送相关管理部门处理，并告知当事人。
第六条市环保局应当加强对区、县环保部门的监督。对区、县环保部门作出的违法的行政许可、行政处分或者其他决定，市环保局应当责令其改正；对区、县环保部门应当依法处理的事项不予处理的，市环保局应当责令其改正。
第七条公安、交通、港口、海洋、海事、渔政、铁路、民航部门依照有关法律、法规的规定，对环境污染防治实施监督管理。
本市其他有关管理部门，按照各自职责，协同实施本条例。

第八条一切单位和个人都有享受良好环境的权利，有权对污染、破坏环境的行为进行检举和控告，在直接受到环境污染危害时有权要求排除危害和赔偿损失。
