第二章 担保条件、形式和范围
第七条  担保人应符合以下条件：
〔一〕具有企业法人资格，能独立承当民事责任；
〔二〕具有良好的资信及代为偿债能力。
第八条  被担保人应符合以下条件：

〔一〕依法经工商行政管理机关核准登记并办理年检手续；
〔二〕独立核算、自负盈亏，具备健全的管理机构和财务制度；
〔三〕具有清偿债务的能力；
〔四〕无逃废银行债务或拖欠贷款本息等不良信用记录；
〔五〕无重大经济纠纷；
〔六〕最近会计年度审计后资产负债率小于70%。
第九条  企业提供贷款担保的，被担保的贷款工程应当符合以下条件：
〔一〕符合国家和本市产业政策要求；
〔二〕符合被担保人主导产业和开展规划；
〔三〕不属于高风险的投资工程〔包括任何形式的委托理财，投资股票、期货、期权等〕。
第十条  企业对外担保的方式以一般保证为主。
第十一条  以下国有资产不得设定抵押担保：
〔一〕未办理企业国有资产占有产权登记的；
〔二〕所有权、使用权不明或者有争议的；
〔三〕依法被查封、扣押、监管的；

〔四〕依法不得抵押的其他国有资产。
第十二条  符合条件的企业之间可以按规定相互提供担保。
企业及其权属企业不得为其参股企业或非市属国有及国有控股企业提供担保，但经市国资委批准的除
