生产、销售用能产品的单位和个人，应当生产、销售低能耗的产品，在规定期限内停止生产、销售国家明令淘汰的产品。
第八条 用能单位不得有以下行为：
〔一〕新建、扩建技术落后、耗能过高、严重浪费能源的工业工程或者其他工程；
〔二〕使用国家明令淘汰的用能设备；
〔三〕将淘汰的用能设备转让给他人使用；
〔四〕引进落后的用能技术、设备和材料；
〔五〕超过单位产品能耗限额用能；
〔六〕其他违反国家用能规定的行为。
第九条 固定资产投资工程工程的可行性研究，应当进行合理用能专题论证。
固定资产投资工程工程的设计和建设，应当遵守合理用能标准和节能设计标准。
第十条 钢铁、有色、煤炭、电力、化工、建材等重点耗能行业的用能单位，应当制定节能规划及其实施方案，采取有效措施，降低单位产品能耗，提高能源利用效率。
第十一条 鼓励生产和使用节能型机动车辆、船舶和农业机械。

机动车辆、船舶应当符合国家能耗标准；超过国家能耗标准的，应当限期改造或者更新。
第十二条 建筑物的设计和建造，应当执行建筑节能强制性标准，采用节能型建筑结构、材料、器具和产品。
