第五条地方各级人民政府应当采取综合措施，控制人口数量，提高人口素质；依靠宣传教育、科学技术进步、综合效劳、建立健全奖励制度和社会保障制度，开展人口与方案生育工作。
地方各级人民政府和相关部门制定的社会、经济政策，应当有利于人口与方案生育工作。
第六条地方各级人民政府及其工作人员在推行方案生育工作中应当依法行政，文明执法，不得侵犯公民的合法权益。
方案生育行政部门及其工作人员依法执行公务受法律保护。
第七条公民有生育的权利，有依法实行方案生育的义务。公民实行方案生育的合法权益受法律保护。
第八条地方各级人民政府应当对在人口与方案生育工作中作出显著成绩的单位和个人，给予表彰和奖励。
第二章人口开展规划的制定与实施
第九条县级以上地方各级人民政府编制本行政区域的人口开展规划，并根据人口开展规划，制定和组织实施人口与方案生育实施方案。

人口与方案生育实施方案应当规定控制人口数量，加强母婴保健，提高人口素质的具体措施。
第十条县级以上地方人民政府方案生育行政部门负责实施本行政区域内人口与方案生育实施方案的日常工作。其他有关部门和单位应当在各自的职责范围内，提出人口与方案生育实施方案的落实措施，共同做好人口与方案生育工作。
第十一条开展方案、方案生育、公安、劳动和社会保障、民政、教育、人事、统计、卫生等部门，应当相互提供有关人口数据，实行信息资源共享。
第十二条方案生育、教育、卫生、新闻出版等部门应当组织开展人口与方案生育宣传教育。
报刊、播送、电视等群众传媒负有开展人口与方案生育的社会公益性宣传的义务。
第十三条乡〔镇〕人民政府和城市街道办事处负责本管辖区域内的人口与方案生育工作，贯彻落实人口与方案生育实施方案。
