因产品缺陷导致的产品侵权责任，侵权者承当无过错责任，即不管加害人是否有过错，均须为其加害行为承当侵权责任。
二、产品瑕疵责任
产品瑕疵产品瑕疵责任又称产品瑕疵担保责任，是指因生产或销售的产品存在瑕疵，即产品质量不符合明示或默示的质量要求，生产者或销售者承当的责任。
依据?中华人民共和国产品质量法?的规定，以下几种情形都是产品瑕疵责任：
