吉林市饱满区人民法院经公开审理，查明上述事实在案，认为：焦洪宝病故后，韩桂兰及其3名子女均未明确表示放弃继承，应视为接受继承。两间房屋中的一间系韩桂兰个人所有，另一间作为焦洪宝的遗产，应由韩桂兰及其3名子女共同继承，其份额均等。韩桂兰生前所立遗嘱合法有效，焦玉珍处分自己份额的房屋所有权行为亦合法有效。被告焦玉英将全部房权据为己有，系对原告焦延平应有份额的房屋产权的侵犯，其行为是错误的。原告焦延平对自己应有房屋产权的主张合理，应予支持。但房屋较小，不便分割，仅能作价分割。该房屋经房管部门作价为13000元。依据?中华人民共和国民法通那么?第七十八条及有关民事法律政策之规定，吉林市饱满区人民法院于1995年2月28日判决如下：
