摘要:农村集体土地,特别是农村宅基地违法违规现象不同程度的存在,不断引起土地纠纷和上访案件的发生,已经成为造成农村社会不稳定的重要因素,正确处理好这一问题,尤为重要。但与国有土地不同,农村集体土地所有权属于本村(集体经济组织)农民集体所有,而管理权在县(市、区)级人民政府,所有权与管理权是完全分离的,因此,解决农村宅基地违法现象又是一个难题。

Abstract: the rural collective land, especially the rural homestead illegal phenomenon the existence of different level, the land dispute and the petition cases occur, resulting in the rural social stability has become the important factors, and how to deal with the problem, particularly important. 一、 农村宅基地违法现象及成因
(1)《中华人民共和国土地管理法》于1986年6月25日通过并颁布实施,此后各地的土地管理部门相继成立,开始了用地审批与确权发证等一系列行政性工作。在此之前,我国农村宅基地管理权在不同地区,或者在相同的地区的不同时间都有所不同。例如:有的在“革命委员会”,有的在“建设委员会”,有的在乡(镇)政府,有的在“农林局”有的甚至处于无人管理的状态,宅基地档案遗失现象比较严重。为了能够迅速理清关系,使工作走上正轨,土地管理部门于1990年前后开展了一次
