第二章 行政执法责任追究范围

第七条 违反规定程序、权限发布行政规范性文件，被有权机关宣布无效或者撤销的，应当追究行政执法责任。
第八条 实施行政处罚过程中的下列行为，应当追究行政执法责任：
（一）没有法定的行政处罚依据的；
（二）擅自改变行政处罚种类、幅度的；
（三）违反法定的行政处罚程序的；
（四）违法委托实施行政处罚的；
（五）不按规定出具处罚文书和财政部门统一印发的处罚单据的；
（六）未尽妥善管理义务，违法使用、损毁或者遗失被扣押财物的；
（七）依法应当举行听证而不举行听证的；
（八）对涉嫌犯罪案件、应当依法移交司法机关处理而不移交的；
（九）对应当予以制止和处罚的违法行为不予制止、处罚的；
（十）其他违法实施行政处罚行为的。
第九条 实施行政许可、行政审批过程中的下列行为，应当追究行政执法责任：
（一）对符合法定条件的申请不予受理的；
（二）申请人提交的申请材料不齐全、不符合法定形式，不一次告知申请人必须补正的全部内容的；
（三）对不符合法定条件的申请人准予许可、批准或者超越法定职权作出准予许可、批准决定的；
（四）对符合法定条件的申请人不予许可、批准或者不在法定期限内作出准予许可、批准决定的；
（五）在受理、审查、决定过程中，未向申请人、利害关系人履行法定告知义务，或者未依法说明不受理申请或者不予许可、批准的理由的；
（六）依法应当举行听证而不举行听证的；
（七）依法应当根据招标、拍卖结果或者考试成绩择优作出准予行政许
