摘要
随着知识经济时代的到来,市场经济的快速发展,驰名商标的重要性己日益为人们所认识,它不仅标示这商品的来源,也代表着企业的商誉和商品的质量,但与此同时,驰名商标淡化这一新型侵权也愈演愈烈,因此有必要给驰名商标提供反淡化保护。对此新型侵权,世界各国建立起相应的法律保护体系,然而我国现有的商标立法与国外立法还存在极大的差距,在许多方面和层次都出现严重的缺陷和空白,针对此现状,通过借鉴国外先进经验,结合我国商标自身发展的特点,对构建我国驰名商标反淡化保护法律体系进行阐述。

ABSTRACT
With the advent of the era of knowledge economy, the rapid development of market economy, the importance of the well-known trademark has increasingly been recognized, and it marked that the source of the goods not only, also represents the enterprise reputation and the quality of the goods, but at the same time, the new type of infringement of well-known trademark dilution is also growing, so it is necessary for the trademark provide anti-dilution protection. To this new type of infringement, countries all over the world set up corresponding legal protection system, however, our existing trademark legislation and legislation abroad, there is great gap in many aspects and levels are severe defects and blank according to the status quo, through draw lessons from foreign advanced experience, combined with the characteristics of brand development in China, for the construction of the trademark anti-dilution protection in China's legal system.
