论汉律对秦律的继承与发展
摘要:秦汉时期是一个无比灿烂的时代,也是一个令人神往而又深思的时代,在这个承上启下的时期所形成的法律体系尤其值得人们去探究。秦汉虽然现在人们合在一起称呼,但是法律的形成和发展过程却有着很大的变化。秦朝以法家思想作为制定法律的思想基础,完成了对战国的统一,而汉朝在秦律的基础上,根据社会现状进一步完善并最终形成影响中国至今的法律思想。秦汉律是中国封建法律的源头,对这个时期法律的研究不仅是秦汉法律的解析也是中国古代法制史的一次解剖,这对中国现行的司法体系的形成也有着十分重要的借鉴意义。

Abstract:Qin and han dynasties is a very splendid era, is also a fascinating and thoughtful era, in the period of the legal system, which forms a connecting link between the preceding and especially worth and han dynasties, although now people together, but the law of the formation and development process has a very big qin dynasty based on the laws of thought of the legalists, completed the unification of the warring states period, and on the basis of the han dynasty in Qin Lv, based on social status to further improve and eventually form influence China's legal thoughts so of qin and han dynasties, is the source of China's feudal law, the study of this period law is not only the law of qin and han dynasties, the resolution is also an anatomy, the ancient Chinese legal for the formation of China's current legal system also has the very vital significance.
