〔二〕依法当场决定对公民处以20元以上至50元以下的罚款，对法人或者其他组织处以20元以上至1000元以下的罚款，认为不当场收缴事后难以执行的。
第九条 向当事人收缴罚款必须当场开具省财政厅印制的等额?湖南省当场收缴罚没款收据?。执法人员当场收缴的罚款，应当自收缴之日起二日内，交至行政执法大队，行政执法大队应当在收到之日起二日内将罚款金额缴付指定银行财政罚没收专户。
第十条 行政执法人员滞留扣押当事人财物时，必须填写省财政厅印制的?湖南省暂时扣留封存、冻结财物收据?四联单，经当事人验明无误后签章。
第十一条 行政执法人员开具的罚款票据和暂扣收据，必须按规定填写日期、地点、单位、姓名和执法依据等。对暂扣财物应妥善保管并及时向大队负责人报告，依法处理。对违法暂扣财物造成损失的，应当依法赔偿。

第三章 一般程序
第十二条 违反县城市管理法律、法规及规章的，除依法可以当场作出行政处分外，行政执法大队发现公民、法人或者其他组织有依法应当给予行政处分的行为的，适用一般程序。
立案调查
第十三条 行政执法机关查处县城市管理违法案件，必须全面、客观、公正地调查，收集有关证据，并采取必要措施，制止其继续违法。
第十四条 查处违法案件应当填写立案审批表，批准立案调查的，由两人以上专人办理。
第十五条 行政执法人员查处案件必须及时查明违法事实，详细制作现场勘验笔录。
第十六条 现场笔录由办案人员当场制作并签名，注明起止时间，由当事人书写“情况属实〞后签名，如当事人认为有误，允许说明，拒绝签名的，在笔录上载明。
第十七条 办案必须询问当事人，询问人不得少于2人。询问时允许当事人陈述、辩白，应如实制作询问笔录，并交由当事人核对或向其宣读，核对无误后，由当事人签名〔盖章〕，拒绝签名的，应在笔录上注明。
第十八条 收集证言，就制作调查笔录，写明调查的时间、地点、证人与当事人的关系、证言内容。笔录须经证人核对，并由办案人员与证人签章。
