   第十条    通报批评适用于执法过错行为性质一般，但可能导致较重后果或者一定社会负面影响的责任人。
   第十一条     责令待岗适用于执法过错行为性质较重，可能导致严重后果或者较大社会负面影响的责任人。待岗期限为一至六个月，待岗人员需接受适当形式的培训后方可重新上岗。
   第十二条      取消执法资格适用于执法过错行为性质、后果严重的责任人。取消期限为一年。被取消执法资格人员需接受适当形式的培训后方可重新取得执法资格。
   第十三条      对责任人员的追究决定，由其所在的县级以上税务机关局长办公会议集体作出。批评教育和责令作出书面检查可以由本单位负责人作出。

       责任人的过错行为造成的后果能够纠正的，应当责令限期纠正。能消除影响的，就及时消除影响。
第三章 追究范围和适用
   第十四条     税务执法人员有下列行为之一的，应当对其进行批评教育，并处每件（次）给予经济惩戒20元—30元：
    （一）未对逾期办理开业税务登记行为按违法违章进行处理的；
     （二）未按规定制作非正常户认定书的；
     （三）未按规定审批延期申报的；
     （四）未对欠税进行公告的；
     （五）未对欠税进行准确核算的；
     （六）未按规定办理政策性退税的；
     （七）对达到立案标准的案件未按规定立案的；
     （八）未按规定查办举报案件的；
     （九）未按规定的时限审结案件的；
     （十）未按《行政许可法》的有关规定进行公开、公告的；
     （十一）其他行为性质、后果较轻的执法过错行为。
    第十五条    税务执法人员有下列行为之一的，应当责令作出书面检查，并处每件（次）给予经济惩戒30元-50元：
     （一）延期申报未按规定核定预缴税款的；
