[摘要]文章在理解数字图书馆知识产权的基础上,分析了数字图书馆在资源建设、资源传播和资源服务三个不同阶段所涉及的知识产权问题,从知识产权保护意识、知识产权法规政策、知识产权管理组织、知识产权保护技术和借鉴国外经验五方面提出了数字图书馆知识产权保护的宏观措施,以及数字图书馆在资源建设、传播和服务三个阶段的微观措施。

Research the Problems and Solutions of Intellectual Property Protection in Digital Library

Abstract:The article understanding and awareness of intellectual property protection on the first, and then analyzed the digital library's problems of intellectual property protection in resource development, resource dissemination and resource services. At last, proposed intellectual property protection macroeconomic measures from the awareness of intellectual property protection, intellectual property regulations and policies, intellectual property anizations, intellectual property protection techniques and learn from foreign experience and microcosmic measures from resource development, resource dissemination and resource services.

1 引言
至上世纪90年代起,随着数字图书馆的兴起,知识产权保护问题便成了数字图书馆研究领域的一个热点。对数字图书馆知识产权的认识,学界众说纷纭,有的从资源建设角度理解,其内容包括馆藏资源数字化建设、数据库建设(商业数据库、自建数据库)、网络资源建设等过程中的知识产权问题;有的从信息服务角度理解,其内容包括数字资源在复制服务、参考服务、传输服务等过程中涉及的知识产权问题。[1-4]笔者从资源流程角度,将数字图书馆知识产权问题划分为“数字图书馆资源建设、数字图书馆资源传播、数字图书馆资源服务”三个不同阶段的知识产权问题,以期更
