第一节国际贸易结算工具
国际结算(International Settlement):通过某种支付工具和支付方式办理货币收付以结清国家之间的债权债务关系的经济活动。
由国际贸易引起的债权债务关系的清算称为国际贸易结算。
结算工具:
货物
货币(黄金、白银)
票据(汇票、本票、支票)
一、汇票(Bill of Exchange;Draft)
(一) 汇票的含义
汇票是一个人向另一个人签发的,要求见票时或在将来的固定时间或可以确定的时间,对某人或其指定的人或持票人支付一定金额的无条件书面支付命令。
(二)汇票的必要项目:
1、应载明“汇票”字样(Bill of Exchange;Draft)
2、无条件书面支付命令(Unconditional order to pay in writing)
3、一定金额(in certain amount)
4、付款期限(tenor):付款人履行付款义务的期限。
①见票即付(Pay at sight/on demand)
②见票后××天付款(payable ×× days after sight)
③出票后×× 天付款(payable ×× days after sight)
④提单日后×× 天付款(payable ××days after bill of lading )
⑤指定日期付款(fixed date)
5、付款地点(Place of Payment):持票人提示请求付款的地点。
6、受票人(Drawee),又称付款人(Payer),是接受汇票支付命令,对规定的受款人支付规定金额的人。
在国际贸易中,它往往是进口商或进口商的往来银行。
7、受款人(Payee),有权凭汇票取得规定金额的人,即汇票的债权人。又称收款人、抬头人
在进出口业务中,通常是出口商或出口商的往来银行
(1)限制性抬头(Restrictive Order)
Pay…only 或 Pay…, not negotiable/transferable
(2)指示性抬头(Demonstrative Order)
Pay…or order 或 Pay to the order of…或Pay…
(3)持票人或来人抬头(Payable to Bearer)
Pay bearer
8、出票日期(Date of Issue)
9、出票地点(Place of Issue)
10、出票人签字(Signature of the Drawer)
