Foreword
ThisrevisionofICC'sUniformRulesforDemandGuarantees(URDG)isthefirstsincetherules
,URDG458,gainedbroadinternational
acceptanceinrecentyearsfollowingtheirincorporationbytheWorldBankinitsguaranteeforms
andtheirendorsementbyUNCITRALandleadingindustryassociations,suchasFIDIC.
Thisfirstrevisionoftheruleswasmeticulouslypreparedoveraperiodoftwoandahalfyears,and

jointprojectbytwoICCcommissions-theBankingCommissionandtheCommissionon
CommercialLawandPractice-thereforetakingintoaccountthelegitimateexpectationsofall

nationalcommitteessubmittedseveralhundredpagesofvaluablesuggestionsonsuccessive
drafts,anumberofwhichwereincorporatedintothefinaltext.
TheICCTaskForceonGuarantees,whichconsistedof40membersfrom26countries,reviewed
,ablychairedby
DrGeorgesAffaki,metonanumberofoccasions,carefullyreviewedallcommentssubmittedby
nationalcommitteesandtheTaskForceanddevelopedthefinaldraft.
Thiscollectiveefforthasbornefruit;ithasproducedrulesthatreflectabroadconsensusamong
bankers,,thepresentrevisionofthe

realityoftheinternationaldemandguaranteemarketandstruckthemostreasonablebalance

demandguaranteesubjecttoURDG,applicantsrenouncedtheirabilitytoobstructpaymentfor
,beneficiarieswereexpected
tostateingeneralterms-butnottojustify,establishorprove-thenatureoftheapplicant's
,becauseademandguaranteeis
anindependentundertaking,guarantorswereassuredthattheircommitmentwassubjecttoits

relationship.
Theirincrementaluse,backedbythesupportofICC,enabledURDG458tomakeacritical
contributiontowardslevellingtheplayingfieldamongdemandguaranteeissuersandusers
regardlessofthelegal,economicorsocialsysteminwhichtheyoperate.
Yet,
theyears,theapplicationoftheirprovisionsshedlightontheneedfordraftingadjustments,
clarifications,
theICCTaskForceonGuaranteesfromURDGusersworldwideprovidedthenecessarymaterial
tolauncharevisionofURDG458thatboththelapseoftimeandtheevolutionofpracticemade

BankingCommissionandtheCommissiononCommercialLawandPractice(CLP).
TheICCTaskForceonGuarantees,thestandingexpertbodycreatedbyICCin2003tomonitor
internationalguaranteepractice,actedasaconsultativebodytoaDraftingGroupthatproduced





methodensuredthattherevisiontakesintoaccountviewsreceivedfromabroadcross-sectorof
concernedparties.
TheresultingURDG758wereadoptedbytheICCExecutiveBoardon3December2009,following

July1,-guaranteewhere

aconsistentcourseofdealingbetweenthepartiestothedemandguaranteeor
counter-guaranteewheresoprovidedbytheapplicablelaw.
ThenewURDG758donotmerelyupdateURDG458;theyaretheresultofanambitiousprocess
thatseekstobringanewsetofrulesfordemandguaranteesintothe21stcentury,rulesthatare
clearer,morepreciseandmorecomprehensive.
