“小产权房”目前已经成为困扰我国房地产市场,挑战我国现行土地法律制度的新问题。“小产权房”的出现与迅速发展不是我国改革与发展的偶然,而是在我国社会体制改革推向纵深之际出现的必然现象。“小产权房”突破了我国现行土地法律制度,成为公认的违法产物。但它是我国社会发展的自发选择,是社会要求改革相关滞后的、不合理的法律制度的一种表达方式,是对我国继续深入改革的强烈召唤。“小产权房”问题已经不是政府一纸禁令所能解决。我们所要做的不是简单地宣布“小产权房”违法,从而予以取缔,而是透过现象背后隐藏的本质问题,看到时代发展的真正需求,从而对我们现行相关法律制度作出深刻检讨与合理调整。
“小产权房”的根源是我国土地法律制度对集体所有土地的不合理限制。“小产权房”的本质问题是集体经济组织和广大农民对参与市场经济并直接分享市场经济发展成果的深切期盼与强烈愿望。只有改革创新我国现行土地法律制度,改变城乡利益分配的二元模式,将广大农村与市场直接对接起来,使广大农村和农民能象城镇居民那样直接参与分享我国改革发展的成果,赋予农村和农民平等的发展权,“小产权房”才能与城镇商品房殊途同归,携手打造城乡一体的房地产市场,为我国下一阶段的社会发展尤其是新农村建设贡献力量。解决“小产权房”问题的根本途径是赋予集体土地完整产权,使集体土地所有权名副其实,推动集体建设用地直接入市流转。加强城乡土地市场体系建设,实行国有建设用地和集体建设用地统一市场,实现“同地、同权、同价”。
本文共分六个部分:导言部分,提出了本文的论题;第一章,概述了“小产权房”的基本情况;第二章,对“小产权房”的相关法律问题进行了分析;第三章,对“小产权房”的根源即我国土地法律制度进行了检讨;第四章,分析了“小产权房”问题的解决路径;结论部分,对文章主要观点进行了简要的总结。

Research on Legal Issues of Partial Property House
Abstract
Partial property house has e a new problem to raid the real estate market and challenge the Chinese current legal system of land. Partial property house does e into being and boom accidentally in the process of reform and development of our country. It’s an inevitable phenomena in the further progress of our social system reform. Partial property house breaches our current legal system of land, so it is looked as illegal real estate. While it’s a result of spontaneous choice of our social development, it’s a way of expression to show some lag or unreasonable regulations have to be amended. It requires that we must proceed our reform. The issue of partial property house can not be resolved by the government’s banning. What we should do is not to announce partial property house illegal, then ban it. The issue is not so simple. We have to recognize the real problem behind the surface, we have to know to the requirements of our times, thereby we could review our legal system seriously and change some bad regulations in it.
