驰名商标反淡化是指驰名商标的显著性经弱化、丑化等形式而遭到减损甚至灭失的行为。由于商标财产化趋势日趋明显,商标尤其是驰名商标的价值远超其生产设备等实体物质的价值,对其提供额外的保护势在必行。在我国进行《商标法》第三次修改的大好契机下,采纳吸收驰名商标反淡化制度正当其时。本文从域外先进立法发展和完善的进程中汲取有益要素,结合我国的国情和商标法律制度的实际情况,在完整介绍驰名商标反淡化制度的理论基础和体系化考察了驰名商标反淡化制度以后,大胆对我国相关立法进行了检讨,并提出了自己心目中的驰名商标反淡化制度以及相关立法建议。
本文的第一章,详细论述了消费者利益在整个商标法的体系中所处的地位和影响。由于社会经济等大环境的巨大变革,商标功能也经历了深刻的发展,从仅仅标示来源到承载企业的商誉,商标价值尤其是驰名商标的价值实体化的趋势愈见明朗,因此需对驰名商标采取额外的保护。笔者引述了国内外针对驰名商标反淡化制度的支持和反对理由,从经济学和社会心理学等角度分析了驰名商标的必要性。
本文的第二章,从驰名商标反淡化制度的历史发展角度详细介绍了驰名商标反淡化理论的概念和沿革等。尤其是全面详细的介绍了2006年刚出台的商标淡化修正法案(TDRA)及其先进方面。同时大略的介绍了欧洲的驰名商标反淡化制度。
本文的第三章,笔者从驰名商标反淡化制度的体系入手,详细的介绍了驰名商标反淡化理论中各引起争论和纠纷的制度。对受到反淡化保护的驰名商标的显著性的要求、驰名的认定等进行了分析。同时对驰名商标反淡化行为的类型、例外情况以及驰名商标反淡化的证明标准和救济等相关内容进行了详细的阐述。
本文的第四章,笔者先回顾了我国驰名商标反淡化保护的立法、司法的现状以及存在的问题。于简单介绍了在我国引进驰名商标反淡化制度的合理性后,对《商标法》第13条和《关于在审理侵犯商标权等民事纠纷案件中认定和保护驰名商标应用法律若干问题的解释(征求意见稿)》的相关条文提出了自己的修改建议,以期能完善我国的驰名商标反淡化制度。

On the Anti-dilution of Famous Marks
(Abstract)
Trademark dilution refers to the decreasing or even the loss of distinctiveness of the famous marks by such actions as blurring and tarnishment. With the growing trend mercialization of trademarks, it is inevitable to give additional protections as the values of trademarks especially famous marks overpass the ones of the real substances such as the manufacturing equipment. Against the background of the third reversion of Trademark Law, it is the very time that the theory of anti-dilution of famous marks was embodied or included. With the basis of introduction of the trademark dilution, this thesis is to review and criticize some relevant legislation of China, propose the ideal policy of anti-dilution of well-know trademark as well as identify the way to perfect the legislation of anti-dilution of famous marks by drawing some significant achievements attained in the process of the oversea legislation and improvement as well bining the current situation of the nation with the legal system of trademarks.
