文档介绍：I摘要终身定期金合同是一个具有重要实践价值的合同,也是大陆法系的学者比较感兴趣的一个问题。在德国、法国、瑞士、意大利、日本、俄罗斯等大陆法系国家和地区的民法典中,均将终身定期金合同作为一种典型合同,予以明文规定,从而通过法律对其进行调整。但是,这个合同在我国的民事领域却一直处于空白状态,在实务中也很少应用。虽然最近理论界对于此种制度有所涉及,但仍属星星之火,尚无燎原之势。本文的写作目的在于通过对终身定期金合同基本理论的介绍,让读者对该合同有一个充分的认识与了解,唤起学术界对终身定期金合同的理论价值与现实意义的探讨。同时笔者通过自己的论证分析,证明在目前我国社会保障体系不够完善,社会保障制度不够健全,社会保障法律不够明细的情况下,终身定期金合同能够起到对我国社会保障体系给予一定补充的作用,我国民法中应该将其列为典型合同予以规定调整。文章分为四个部分,在终身定期金合同基本理论方面,笔者通过对终身定期金合同概念、起源、立法例、性质和特征的比较和介绍,希望读者能够对终身定期金合同有一个全面的了解,也为制度的比较做好铺垫;在终身定期金合同与相关制度的比较方面,笔者通过与商业保险制度、信托制度、遗赠扶养协议、租赁合同制度、人身损害赔偿中定期金制度等五个制度的全面比较,彰显终身定期金合同在社会保障方面的优越性,突出其实践意义;在终身定期金合同的功能方面,通过揭露我国目前社会保障制度的不足之处,突出终身定期金合同在私法方面的优越性,弥补社会保障方面的不足;在终身定期金合同效力方面,笔者探讨终身定期金合同关于债权和债务以及消灭三个方面的效力;笔者结合上述四个部分的理论,在结论部分提出自己的立法建议。关键词:终身定期金合同;社会保障;标准人;定期金IIAbstract Contract of annuity for lifetime is a contract has important practical value, it is also an interesting issue for Continent genealogy of law Scholars. In the civil law of Germany, France, Switzerland, Italy, Japan, Russia,contract of annuity for lifetime is formulated as representative contract, and use civil law to adjust it. But contract of annuity for lifetime is not formulated in our contract law, and it is also seldom used in public life. Although theoretical circles begin to discuss this problem, but the scope is very small. The writing purpose of this article is to introduce the basic theory of contract of annuity for lifetime, let our reader understand this contract, arouse academics to discuss the theoretical value and practical significance of contract of annuity for lifetime. Author use demonstration analysis prove that in the circumstances that the social security system is not perfect enough, the social security system is not sound enough, details of social security law is not enough, contract of annuity for lifetime can cover the defects of our social security system, our civil law should formulate this contract.
