论文摘要

传统知识的保护是现今知识产权领域边缘性的但是又极富挑战
的议题。随着现代社会和科学技术的发展,传统知识在生物多样性和
文化多样性等领域的重要作用日益突显。传统知识所蕴涵的巨大的、
可开发的价值日益受到人们的重视。传统知识是传统社区居民之持续
生存发展的基础,也是人类文化遗产的核心要素。但由于我国对传统
知识保护的起步较晚,相关法律法规还不不完善,导致在实践中传统
知识保护的严重不足。本文对传统知识保护的基础理论做了深入的研
究与探索,在此基础上提出了我国传统知识保护的立法建议,以期更
好地为我国实践服务。文章采用了价值分析法,历史分析法和理论与
实践相结合的分析方法。分析思路体现在文章的行文结构中,总体上
是先对传统知识术语的界定和认识,再以国际层面对传统知识保护的
相关规定和立法实践的比较分析研究为展开,最后归结于我国的立
法。
除了引言和结语外,全文共分四章。
第一章是传统知识的界定与认识,首先概述了传统知识的历史沿
革,并通过对不同国家和国际组织对其内涵的界定的研究分析,提出
自己的看法。接着分析了传统知识的一般特性与法律特征,旨在深化
论文研究的理论意义。
第二章采用了历史分析法,通过 WTO、WIPO、WGIP、FAO 等国际
组织的相关规定,论述了传统知识国际保护的演进脉络,并就这些国
际组织的规定进行比较分析,得出经验以期给我国予启示。
第三章首先介绍了传统知识保护的困境以及对其进行保护的必要性和正当
性,接着对我国传统知识保护的法理念作了分析,希望能对我国传统知识的法律
保护有所帮助。
第四章在前三章的基础上以民间文学艺术保护为例审视我国传
统知识保护的法律框架,指出了我国在民间文学艺术法律保护方面存
在的不足,并提出了相关的立法建议。

Abstract

The preservation of traditional knowledge, although remaining as a peripheral
topic for discussion, has now e a challenging one in intellectual property. With
society and technology development, traditional knowledge is playing an increasingly
significant role in biological and cultural diversity. And people are aware of the
importance of immense wealth to be developed in traditional knowledge. Traditional
knowledge is the basis for sustainable development of people in traditional
communities and also the essentials of human cultural heritage. In china, this issue of
traditional knowledge has not been thoroughly studied and the laws and regulations
have so many deficiencies, which causes confusion in practice, so China should
progressively perfect the legislations. Adopting the viewpoint of valuation, basic
theories are analyzed in the first part of this thesis. Based on the current situations
about protection of traditional knowledge, suggestions to perfect the legislation of
traditional knowledge of our country are presented in the following parts, with theory
combining with real examples.
