ABSTRACT
In recent years, domestic aviation of checked baggage has increasingly attracted the attention of consumers and the media, resolving aviation checked baggage transport disputes lies in the clear air carrier liability constitution. This dissertation focuses on the exploration of the checked baggage transport in domestic aviation and the main line of the carrier’s liability institution. By using the method of text research parative studies, empirical research and institutional research, system analysis and value evaluation, this article will sort out and analyze the existing problems of carrier’s liability institution of the checked baggage in domestic air transportation and put forward a sound proposal, which aims to provide a basis for consumer rights, improve the carrier’s operability of handling checked baggage disputes in accordance with laws and regulations, including the basic laws and the special laws.
In addition to the introduction and conclusion, the body part of this dissertation divided into three chapters to explore theoretical and practical study.
The first chapter analyzes the position of the carrier’s liability institution of the checked baggage transport in domestic aviation, including the principle of responsibility, position pensation. The first part aims to sort out the relationship between the different levels of laws and regulations and clarify the legal definition of domestic air transport related concepts. The second part further describes the principle of liability of the checked baggage damage and delay and the
impunity reasons. The third part analyzes the nature of the responsibility and liability of the carrier in checked baggage transport and the domestic legislative situation. The fourth part clarifies the standard pensation of the checked baggage damage and delay and the exceptions to the liability limits.
