摘要:我国改革开放至今,已经走过了二十八年的历程,近年来,我国的经济逐步进入高速发展期,良好的投资环境、先进的政府理念,吸引了大批投资者进入。
随着世界经济一体化的趋势和我国加入WTO,我国的经济制度正快速向国际惯例接轨,北京2008年奥运会的举行,使越来越多的国家和企业认识到了中国市场的庞大和潜力,大批外资涌入到建筑市场来,国际承包商和投资商纷纷在中国开展业务。面对机遇和挑战,引进国际通行的工程管理方法和合同文本,推进国际惯例的建筑投资管理模式对培育良好的建筑市场经济秩序,更好的监控建设项目资金的利用,促进外资大胆放心的投入到各种工程项目的建设,净化投资环境具有重要意义,同时为我国建筑企业走出国门,外国建筑企业进入中国市场,作好充分准备。
JCT合同条件是英联邦国家和我国香港、澳门地区通行的建设工程合同条款, JCT系列的标准合同门类齐全,体系完备,条款详尽,涵盖了建设工程各个层面, 并且在工程项目管理上起到了指导作用,自1991年我国上海某工程首次使用以来, 经过十几年的发展,已有一百多个国内外工程项目应用了JCT合同,经过不断摸索和实践,已基本成熟完善为适合我国建筑工程项目的合同文本,具备了推广的条件。
本文首先分析了我国目前建设工程项目合同管理、工程管理、造价控制的现状,然后介绍了JCT合同体系的由来及其合同体系的发展和构成以及其主要内容, 接下来从建设工程项目实施过程中的各个阶段,说明了JCT合同在招投标、进度与质量控制、工期管理以及造价控制等方面的优点以及在国内工程中应用的局限性。进一步选取工程示例,介绍了JCT合同在国有大型建设工程项目中起到的良好作用,存在的问题以及解决方法。比较了JCT合同与我国现行建设工程施工合同的不同之处并提出修改完善我国建设工程施工合同的建议。针对目前形势和我国建筑市场各方存在的问题和差距,提出了完善我国建筑市场体系的建议
