摘要
本文运用经济分析的方法对船舶碰撞中的有效预防、责任归属、损害赔偿及损害赔偿纠纷的解决途径等问题加以分析,主要目的在于介绍一种新的法律分析方法,从新的视角审视当前船舶碰撞的相关规定。
船舶碰撞既是~种权利冲突又存在相互性,在解决船舶碰撞相关问题时,我们始终关注对整个社会成本的影响,即围绕着最小化社会成本,对船舶碰撞的有效预防、责任归属和损害赔偿进行考量。在就船舶碰撞损害赔偿纠纷的解决途径进行分析时, 更多的是从纠纷当事人的立场上来选择有效地解决途径。
本文共由六章组成,其中: 第一章主要介绍法律经济分析的概念和对本文研究的启示,为之后的分析作铺
垫。
第二章由船舶碰撞存在权利冲突入手,着眼于社会成本的最小化对船舶碰撞风险分配进行经济分析,确定船舶碰撞的有效预防标准。
第三章为损害赔偿理论,确认了船舶碰撞损害赔偿责任的归属,并对比较过失规则的有效性进行分析。
第四章主要对船舶碰撞损害赔偿进行经济分析,考察不同的损害赔偿范围对双方当事人的不同激励作用,并对惩罚性损害赔偿在船舶碰撞损害赔偿中是否适用做简要分析。
第五章探讨船舶碰撞损害赔偿纠纷有效解决的问题。第六章为结论,对本文论述内容所作的总结。

船舶碰掩的经济分析
ABSTRACT
The thesis analyses the effective prevent,the responsibility,the damages and the solutions of the issues of damages of collision of ships,by the theory of economic analysis of purpose is to introduce a new method to analyses
the Iaws about collision of ships.
Collision of ships is a conflict of rights,to solve the relevant problem on the purpose of reducing social are on the behalf of the two parties to analyses the different beneficial result of solutions of the issues of damages.
The thesis consists of six chapters with the main content of each chapter as
foIlows:
Chapter 1 introduces the conception and theory of Economic Analysis of‰
providing the theoretical support for the following text.
Chapter 2 to analysis the distribution of risks based on the purpose of reducing social costs。and find out the effective standard avoiding collision of ships.
Chapter 3 confirms the responsibility of the damages and the effective of parative negligence regulation.
Chapter 4 to analyses pensation for damages and the exemplary damages in collision of ships,by the method of economic analysis of law.
Chapter 5 investigates the effective solutions of the issues of damages of collision of ships.
Chapter 6’’Conclusion”is a summary of the thesis.
