进入21世纪以来,建筑业的快速发展已经成为了我国国民经济的新的增长点,为我够经济发展进入快车轨道做出重要的贡献。但是,建筑业存在的许多问题时不容忽视的。比如:施工合同的效力问题、工程质量问题、市场行为问题、投资不足、黑白合同等等。这些问题对于建筑业的正常发展产生了十分严重的影响。所以建工合同管理规范化已经迫在眉睫。
本文分析了建设工程合同管理的目的和意义以及所处地位,阐明建设合同管理规范化的内涵,分析当前我国建设工程合同还存在的一些问题,借鉴西方发达国家的先进管理经验,归纳诸多问题的原因。就信用管理体系的缺陷、合同管理的落后、诚信的缺失、相关法律法规的不完整、合同管理人才匮乏、发包方以及承包方等有法不依等等问题一一进行仔细的分析,并针对这些问题提出建设工程合同体系、逐步建立并完善我国建设工程合同体系、推行合同示范文本制度、培养专业化人才、加强并完善建设领域的立法与执法、建立一支高素质,网络化的管理队伍、坚持全面,合理地评审合同等建议。
