男女双方因婚姻的缔结而成为夫妻,形成夫妻关系。夫妻财产关系基于夫
妻人身关系而产生,是夫妻关系的重要内容,同时也是民事法律关系的重要组
成部分。我国婚姻法实行夫妻法定财产制与约定财产制并存的夫妻财产制度,
以夫妻财产婚后所得共同制为夫妻法定财产制。夫妻共同财产作为维持婚姻家
庭生活正常进行或存续的物质基础和保障,其范围的认定、权利的内容和行使
效力等问题在夫妻财产制中显得尤为重要。
随着我国社会主义市场经济的发展,夫妻共同财产的类型日趋多样化、复
杂化。哪些财产属于夫妻共同所有、夫妻对共同所有的财产享有怎样的权利、
应负担怎样的义务,成为婚姻法必须明确的问题。而解决这些问题的前提,是
对夫妻共同财产的范围予以明确认定。另外,夫妻双方通过离婚解除婚姻关系
时,需要对夫妻共同财产进行分割,以便明确双方对共同财产的权利与义务。在
对夫妻共同财产进行分割时,夫妻共同债务的分担不仅涉及到夫妻之间的财产
权益,同时也将涉及对第三人利益的保护。
本文共分为四部分:
第一部分是夫妻共同财产的范围,通过对“婚姻关系存续期间”及“夫妻
所得共同财产”的概念界定,确定了夫妻共同财产的外延,明确了不应纳入夫妻
共同财产范围的婚姻关系存续期间所得。
第二部分是夫妻对共同财产的权利,包括单方处理权即日常家事代理权和
共同处理权,从权限范围、行使效力和滥用后果几方面分别予以深入探究。
第三部分是夫妻共同财产的分割,在原有的离婚时分割和夫妻一方死亡时
的分割基础上,补充论述了婚姻关系存续期间夫妻共同财产的分割。
第四部分是夫妻共同债务的承担,在认定夫妻共同债务范围的基础上,阐
述了婚内和离婚时对夫妻共同债务的清偿问题,并就夫妻共同债务之债权人的
利益保护进行了深入探究。
