侦查监督权实证研究
----兼论侦诉一体化

摘要:当前由于检警关系的不合理,导致在实践中检察院对公安机关的刑事侦查缺乏有效的监督手段,其监督结果也必然不理想。由于当前是缺乏全程监控的静态监督,很难发现侦查活动中的违法行为,所以我们必须采取措施变事后为事中、变静态为动态,以保证侦查监督的有效进行,维护侦查活动的合法性,提高人权保障水平。侦查权作为一种国家权力,必须遵循权力运行的客观规律,必须对其进行严格的制约,侦查监督应该充分体现人民利益,坚持法制,客观、公开、及时、有效并且相对独立,笔者拟就通过对G省N市基层院侦查监督情况的研究,提出侦查监督的完善建议。
