陕西秦岭地区生物多样性保护的立法研究

摘要
陕西秦岭地区因生物资源丰富,被称为生物多样性的宝库,是研究生物多样
性的重要基地。同时陕西秦岭地区的生物多样性对维护当地生态系统平衡、促进
陕西经济发展也具有重要意义。因而加强陕西秦岭地区生物多样性的保护具有重
大的科学研究价值、生态价值和经济价值。但近年来,受自然及人为因素的影响,
秦岭地区生物多样性遭到了破坏,制约了该地区的全面发展,亟待对该区的生物
多样性保护进行系统的研究。目前,针对陕西秦岭地区的生物多样性保护较少且
大都是从生态学角度出发,而法律角度的研究较少。基于这一现状,论文从法律
角度研究陕西秦岭地区的生物多样性保护,希望为陕西秦岭生物多样性保护提供
理论依据,对国内其它地区的生物多样性法律保护提供一定的参考价值。
论文基于生态系统论和平衡理论,通过文献分析法和实地调查,对陕西秦岭
地区的生物多样性保护现状进行了系统分析;运用归纳方法梳理了陕西秦岭地区
法律法规中涉及生物多样性保护的法律条款,从法律体系和法律内容的层面探讨
了其存在的不足;运用法理学、生态学、社会学等多学科交叉研究法分析了其产
生的原因;并运用比较分析法,对国内外生物多样性保护法律与陕西秦岭地区的
生物多样性法律进行对比分析,借鉴其先进经验。在上述研究的基础上,从法律
体系和法律内容两个方面提出了完善的法律建议:在法律体系方面,加强地方性
立法,并制定相关的配套实施细则的建议。在法律内容方面,填补法律保护空白、
扩大法律保护范围、更新法律保护内容、完善法律保护制度的建议。

ABSTRACT
Shaanxi Qinling Mountains is famous as a plant and animal kingdom and an
important bases for biodiversity research for its wide variety of the animals and the
plants. The biodiversity of Shaanxi Qinling Mountains is key to maintaining the
balance of local ecosystems, Promoting economic development of Shaanxi province.
Thus , the wide variety of the animals and the plants is not only playing a key role to
the ecological balance,and having enormous economic and scientific value. However,
the biodiversity have been damaged in Shaanxi Qinling Mountains in recent years by
human and nature. As a result,it is urgent to protecting biodiversity in the area of
systematic research for prehensive development of the Shaanxi Qinling.
Currently,studies on the biodiversity conservation on Shaanxi Qinling Mountains is
almost on the ecological,few on law.
For this reason,focused on the biodiversity conservation, the paper is from the
point of view of the law,and may benefit to the biodiversity conserva
