内容摘要
引渡是一种历史悠久的国际刑事司法协助方式。现代引渡制度的一些基本的原
则,如死刑不引渡、政治犯不引渡等原则等,随着国际、国内政治经济关系的发展
变化,其内容也在不断的丰富和更新。引渡制度在打击跨国犯罪、集团犯罪、智能
犯罪等方面,成为各与稳定发挥着重
要作用。
随着我国经济的迅速崛起,经济犯罪嫌疑人外逃现象十分严重,严重影响了我
国的经济发展与社会稳定。为了打击这类犯罪,我国与外国的引渡合作也日趋频繁。
由于我国的引渡立法起步较晚,有关引渡制度方面的立法存在着许多不完善的地
方,一些规定甚至与我国加入的国际公约相矛盾,影响了我国同西方发达国家签订
双边引渡条约,从而极大的阻碍了我国同其他国家引渡合作的顺利开展。本文第一
章简要介绍引渡制度及相关引渡基本原则。第二章结合我外逃经济犯罪嫌疑人引渡
实践,深入剖析我国引渡制度中存在的问题。第三章就如何完善我国的引渡制度提
出自己的建议。

Abstract
Extradition is a way of international criminal legal assistance with a long history.
Some basic principles of modern extradition,for instance,the the principle of
non-extradition of death penalty, principle of non-extradition of political offences, etc.,as
international and domestic political and economic relations, development and changes,
its contents are continuously enriched and updated. In the fight against transnational
crime, organized crime, intelligence crime, etc., the extradition is a most effective means
in national punishment for a crime,it plays an important role in ensuring peace and
stability of the world.
As China's rapid economic rise, the phenomenon of economic crime suspects flee is
serious,which has seriously affected China's economic development and social stability.
In order to hit this kind of crime, cooperation on extradition between China and foreign
countries are ing increasingly frequent. Since China's extradition legislation started
late, there are many imperfections in legislation relating to extradition system. Even
some of the provisions contradict international conventions which China had joined,
which affected signing of a bilateral extradition treaty between our country and western
developed countries,thus greatly hinder our cooperation on extradition with other
countries, carried out smoothly. This
