内容摘要: 在社会主义市场经济条件下,夫妻对其财产的处分直接关系到夫妻在家庭中的地位和家庭的稳定,也关系到市场经济的健康发展。婚姻家庭关系是身份关系与财产关系的统一,夫妻间的财产关系,是婚姻共同生活不可或缺的物质基础和保障,也是夫妻关系的核心。因此,夫妻财产的相关事项须事先以夫妻财产制加以规范,夫妻财产制集身份法与财产法的特定于一身,是婚姻效力的一项重要法律内容,也是近现代家庭财产制的重心所在。本文就夫妻财产制的相关概念,结合《婚姻法》及三个司法解释进行了论述,体现了夫妻财产制在婚姻家庭及社会稳定中的重要性。

On the matrimonial property regime

Content abstract: In the socialist market economy, the couple disposition of their property is directly related to the status of husband and wife in the family and family stability, but also to the healthy development of the market economy. Marriage and family relations are property relations as relations with the unity of the property relations between husband and wife, marriage, living together is an essential material basis and security, but also the core of the relationship between husband and wife. Therefore, issues related to marital property to marital property prior to regulate the system, matrimonial property law and property law as set of specific one, is the effect of marriage is an important legal content, but also the modern family property, the focus of the system. In this paper, the concepts of matrimonial property system, combined with the "Marriage Law" and the three judicial interpretations are discussed, reflecting the matrimonial property in marriage and family and the importance of social stability.
