环境信息公开制度研究

摘要�
随着现代化进程的推进,环境污染和破坏愈演愈烈,也惊醒了人们的环保
意识。环境要素蕴含的信息作为影响人类生存状况的重要因素,也日益被公众
所关注。��年初,《政府信息公开条例》和《环境信息公开办法》出台后,我
国的环境信息公开制度得到了系统规定。本文分析了制度的出台背景并介绍了
环境信息公开的理论基础。它的建立不仅是保障公众环境知情权、人民主权的
要求,也是实践的迫切需要。�
这两个法律文件出台前,国内已有环境信息公开的立法和实践。本文对出
台之前和之后的环境信息公开制度作了分析,并指出了现行规定存在的不足之
处,这些地方正是制度完善的着力点。�
另一方面,美国、欧盟、英国等发达国家和地区的政府信息公开以及环境
信息公开制度已经有了很大的发展。笔者从政府信息公开的原则,环境信息公
开的主体,公开的内容等方面分析和总结了国外经验。这也是我国制度完善需
要借鉴的地方。�
如何完善现行的环境信息公开制度是本文的归结之处。参考国外的经验,笔
者提出以法律形式明确规定政府信息公开原则和环境知情权,扩大公开环境信
息的义务主体以及提高环境信息供给水平等。这些建议即使无法短期内实现,
也是前进的方向。随着民主法治进程的推进,完善的环境信息公开制度必将为
我国环境保护事业的发展做出更大的贡献。�

Abstract
With the development of modernization, the pollution and destruction
of environment have been more and more worse, which wakes up the
human-being’s consciousness of protection of environment. The
information of environmental elements affects human-being’s living
circumstances. So people now are more cared about it and hope to
acquire it as well.
At the beginning of 2007, after the release of Regulation on Disclosure
of Government Information and Measures of Disclosure of Environmental
Information, environmental information disclosure system has been
established. This essay analyzes the background of the new system and
introduces the theory Basics of environmental information disclosure. Its
establishment not only contributes to protecting people’s rights to know
environmental information and ensuring People’s Sovereignty, but also
meets the requirements of practice.
Even before the two documents above, there are related legal
documents and practice. Base on the analysis of environmental
information disclosure system, Deficiencies are pointed out which need to
be improved.
