网络游戏***的犯罪学研究

摘要
从犯罪学角度研究网络游戏***,目前理论界鲜有探讨。随着网络的普及与网络技术
的发展,网络游戏的受众群体越来越广泛,规范网络游戏市场也越来越受到民众的关注。
与此同时,网络游戏***者趁网络监管体制和法律制度尚未健全之际,为获取非法财产利
益,侵入网络游戏领域。因此在网络游戏业迅猛发展的今天,研究网络游戏***犯罪,规
范网络游戏市场,是刻不容缓的,也是现实的要求。本文拟对网络游戏***进行犯罪学研
究,以抛砖引玉。
全文分为正文、结语两大部分,约三万字。正文包括四部分:第一部分网络游戏***
研究的犯罪学意义。笔者由曾经办理的一起网络游戏***刑事案件,引发本文议题的思考。
并通过对网络游戏***的概述,网络游戏***的产生、现状和发展趋势,以及网络游戏私
服产生的危害等方面,论述研究网络游戏***犯罪的现实意义。第二部分网络游戏***的
犯罪手段、犯罪特点和犯罪成因。通过分析网络游戏***犯罪的非法架设途径以及运营方
式,论述了网络游戏***的犯罪手段、特征;通过分析网络游戏***犯罪的智力性、社会
危害的持续性、被害客体内容的多样性、犯罪行为的隐蔽性等特点阐述了网络游戏***犯
罪的特殊性;另外,笔者还从经济利益、监管体系等方面论述了导致网络游戏***犯罪的
犯罪成因。第三部分网络游戏***的法律规范和实践控制。该部分从我国民事法律规范、
行政法律规范和刑事法律规范的角度论述我国当前针对网络游戏***的法律调整以及立
法中的缺陷。第四部分网络游戏***犯罪的防治。该部分从加强技术防控、提高知识产权
保护意识、建立行政监管体制、完善知识产权立法等多角度,提出对网络游戏***进行治
理和防范。并且笔者提出了个人对于建立网络游戏立法体系的一点构想。在结语部分,笔
者对文章的核心论点进行了归纳。
