中文提要
全球变暖,自然灾害频频发生,人类居住环境是一年不如一年。环境保护已
经成为人类生存可持续发展的首要难题。而我国目前仍然沉浸于经济高速发展的
热潮中,民众的环境保护意识可以说是相当得弱,而地方政府对环境保护工作也
仍不够重视。环境民事公益诉讼应是日益推进环境保护的一个重要民事司法救济
方式,也是环境保护最后一道防线的重要组成部分。环境民事公益诉讼一来唤醒
民众的环境保护意识,通过司法途径来维护社会公共环境利益;二来弥补地方政
府热衷于发展经济的同时改善环境方面工作之不足。所以本文主要以环境公益诉
讼之民事诉讼为主线,在考察国外环境民事公益诉讼的有效做法基础之上,分析
我国环境民事公益诉讼现状和存在问题,从理论、立法、制度等方向提出几点推
进构想,初步探索一下我国环境民事公益诉讼发展的一些新思路。

Abstract
The earth being ing warmer and natural disasters breaking out frequently,
human living condition is worse and worse. Enviornmental protection has e a
question of questions for sustainable development of human survival. However,
countrymen are still immersed in the upsurge of rapid economic development, and have
poor public awareness of environmental protection. Meanwhile, local governments
haven’t given enough attention to environmental protection either. Environmental
Public Interest Litigation should not only be an important way to promote
environmental protection constantly, but also an ponent of the last
defense for it. Environmental public interest litigation may arouse people a sense of
environmental protection, through judicial channel and helping them safeguard social
and public environmental benefits. On the other hand, it may make up for the
inadequate environmental improvement of local governments while they are keen to
economic development. Along the main line of civil action in public interest litigation
for environment, grounding on several studies of efficient manuvers for environmental
civil public interest litigation aboard, this essay analyses the current condition and
problem of the civil public interest litigation for environment in China and makes
primarily exploration on some new ways thinking for the development of t
