耕地资源是人类赖以生存和发展的基础,是自然界中数量有限且不可再生的资源。保护耕地资源是我国社会经济和农业可持续发展的最基本要求。我国现行的《土地管理法》、《士地管理法实施条例》、《基本农田保护条例》、《土地复垦规定》、《耕地占用税暂行条例》等一系列的耕地保护制度,在对耕地资源的保护、防止耕地资源的破坏和流失方面起了重要作用。
但是,随着人口的持续增长和工业化、城市化进程的不断加快,耕地资源在利用过程中出现了许多令人担忧的问题。我国现行的一些耕地资源保护法律制度已经不能适应目前耕地资源面临的严峻形势,需要进一步的完善以适应环境、经济、社会发展的需要。本文从目前我国耕地资源面临的严峻形势入手, 深入地分析了耕地资源保护的法制状况,揭示了现行耕地资源保护法律制度存在的不足及造成这些不足的原因。
为了借鉴国外的先进经验,本文还对美国、日本、英国、德国等国的耕地资源保护法律制度进行了研究,从中获得了许多有益的启示。在此基础上提出了完善我国耕地资源保护制度的路径,即:搞好土地利用规划,完善相应的审批制度;明确耕地征用范围,完善耕地征用行政许可制度、耕地征用补偿制度和耕地征用程序;合理界定耕地租赁权,完善耕地租赁制度,建立耕地地籍档案完善不动产物权登记;与此同时,对《刑法》中耕地保护的相关内容进行完善,充分发挥出刑罚对耕地资源犯罪的预防功能。

Protect plantation resource is the basis require that continuance development munity economy and agriculture in our country. These actual plantation protection such as ground manage law、 the implement statute of the ground manage law、the statute of protect basis farmland and so on o perate on protect plantation resource and avoid
destroy .
At the same time, along with the continuance increase of population and the step on the juice of industrialization course, the plantation resource appear much problem at course of imposition. The actual law and system are cannot adapt the austerity position of plantation resource, and it is need to consummate to adapt the development of environment、
economy and society. The article analysis that the legal system status of the protection of plantation resource, and post that shortage and causation of the actual law and system of plantation resource protection.
