论网络游戏虚拟财产的刑法保护

摘要
随着网络游戏在全球范围内的风靡,网络游戏玩家的数量与日俱增,网络游
戏虚拟财产交易市场规模也随之扩大,随之而来的是侵犯虚拟财产的案件层出不
穷。而对虚拟财产这一新兴事物,法律将如何对其加以保护,不仅关系到参与网
络游戏的玩家,更关系到我国网络游戏产业的健康发展,不容忽视。
本文将从网络游戏虚拟财产的界定入手,分析虚拟财产的性质、特征,并对
当前有关虚拟财产权的各学说进行评析,认为虚拟财产具有物权法上“物”的特
征。在此基础之上,笔者对我国侵犯虚拟财产的现实案件进行分析,对侵犯虚拟
财产行为的社会危害性和应受惩罚性进行分析,阐明虚拟财产急待刑法保护的观
点,并从可能影响定罪量刑的虚拟财产价值评估方面进行论述。
在对侵犯虚拟财产行为进行法理分析后,笔者针对我国在虚拟财产刑法保护
的立法现状,提出刑事立法在虚拟财产保护方面的缺失是造成现在对侵犯虚拟财
产案件判决结果不一致的根本原因。为解决这一问题,笔者建议在确认虚拟财产
的法律地位的基础上,通过对现有刑法作扩张解释或增加相关罪名等方法,将虚
拟财产真正纳入到刑法保护的范畴。实现对虚拟财产的刑法保护,将是我国刑法
在新时期下,顺应时代发展的又一次完善,也是促进我国游戏产业健康发展、维
护社会稳定的重要保障。

Abstract
With work game's popularity worldwide, increasing the number of
network gamers, network game virtual property transactions also will expand the size
of the market, followed by a case of violation of an endless stream of virtual property.
While the emerging virtual property thing, how it would be legal protection, not only
to participate in work gamer, also related to the work game
industry's healthy development, can not be ignored.
This article will define the Virtual work, analyzes the nature of
virtual property, characteristics, and present the assessment of various doctrines that
virtual property has a property law to "objects" feature. On this basis, the author of the
violation of virtual property in China to analyze the reality of the case, acts of
violations of virtual property harm to society and should be subject to punitive
analysis of pressing criminal law to protect virtual property clear view, and from the
conviction may affect Sentencing of virtual property value assessment for discussion.
