[摘要] 界定了著作权例外和适用于图书馆的著作权例外的定义。在此基础上,从赋予我国图书馆著作权例外的著作权法律和对我国图书馆较为重要的著作权例外两个角度,剖析了适用于图书馆的著作权例外与图书馆实务的关系,归纳出可适用于图书馆的著作权例外的立法趋势呈现为:维持动态平衡性、直接受信息技术影响、国际性的趋势不断加强和标的物更加多样化。

On Copyright Exception Applicable to Library World and Its Legislation Trend

[Abstract] The definition of copyright exception and copyright exception applicable to library world is made distinctly in this paper. On that basis, the author discusses the relationship between copyright exceptions and library practice from the two perspectives: the copyright laws regulating copyright exceptions applicable to library world and the copyright exceptions applicable to library world, pointing out that the legislation trend of copyright exception applicable to library world can be summarized as follows: the homeostasis, effect by information munication technologies, increases in internationalism and the subject-matter ing more diverse.

1、引言
著作权例外是指[1],依据著作权法律的规定,或者是依据版权拥有人让渡部分专有权的声明(如CC协议),在一定情况下,可以不经版权拥有人授权也无须补偿版权拥有人就可以按照一定形式来使用版权作品;或者在一定情况下可以不经版权拥有人授权就可以按照一定形式来使用版权作品,但要补偿版权拥有人;或者是不需要承担侵权责任的其它特定情形。而适用于图书馆的著作权例外则是著作权例外在图书馆领域的应用,具体是指[1]:在著作权法律框架下,依据著作权法律的规定,或者版权拥有人让渡特定的著作权专有使用权的自我意愿表达,图书馆在信息资源的收
