摘要: 目的探索新药研究中的知识产权保护道路,策划我国的新药研究知识产权策略。方法检索国内外知识产权信息,对86家制药企业进行问卷调查并对所得数据进行统计分析。结果与结论客观地介绍了新药研究中的知识产权保护现状,对比分析评价了我国医药知识产权的不足,并提出新药研究中的知识产权策略。

Protection of Intellectual Property Rights in New Drugs Research

Abstract: Objective In order to probe into the strategies of protecting intellectual property in new drugs research. Methods The information of intellectual property was searched at home and abroad. The questionnaires were made in 86 pharmaceutical corporations and the data was analyzed statistically. Results and Conclusions The current situations about protection of intellectual property rights in new drug research were introduced objectively. The insufficient of national medical intellectual property was analyzed and evaluated contrastively. Moreover, some protective strategies of intellectual property were put forward in new drugs research.

医药领域知识产权,是指一切与医药产业领域有关的发明创造或者劳动所产生的智力成果的财产权,它包括专利、商标、商业秘密、技术秘密和版权[1]。另外,就医药行业来说还有特殊的行政保护政策,如中药品种保护和新药监测期保护等不同的形式。我们检索了国内外医药知识产权信息,并对86家制药企业开展问卷调查、实地走访,调研了医药企业知识产权保护的基本情况。
