【中文摘要】长期以来,商业方法作为一种智力活动的规则和方法,被排除在专利授权的范围以外,然而随着科技的发展,技术的进步,商业方法的内涵进一步延伸,范围也逐渐扩大,对传统商业方法的保护,已经不能适应当今的发展需求。并且,随着商业方法带来的高额经济效益,美国等国家逐渐将商业方法纳入专利权领域,在我国,将商业方法纳入专利的保护范围,成为一个新的迫切的问题。商业方法专利虽然备受争议,但却已慢慢成为主流趋势。对此,我国应采取必要的应对措施,建立特有的专利制度保护自身特色和国家利益,融入到新的情势之中,从而在国际交流和合作中取得主导和先机。本文从商业方法的内涵着手,分析了商业方法专利化的可能性和必要性,并通过比较欧美日等其他国家的相关实践的利弊,详细的解析了我国在商业方法进程中应该借鉴的经验和吸收的教训,进而分析了商业方法专利化在中国的可行性,以及面对商业方法专利化,为了更好的保护我国的国家利益和企业的自身利益而应采取的应对策略。
【英文摘要】For a long time, as a kind of rules dealing with mental activities, commercial methods were always excluded from the rights authorization. However, with the development and advancement of technology, the contents mercial methods are enlarging, apparently, the protection of mercial methods is not suitable for the current development. And owing to the high economic benefits, American and other countries are gradually authorizing mercial methods. Although bringing up many disagreements, authorizing mercial methods is ing the main stream. Facing with these conditions, we should take necessary measures to set up protection system for preserving our own characteristics and national benefits.
