夫妻共同财产制的相关问题研究
中文摘要
夫妻财产制度又称婚姻财产制度,是关于夫妻婚前和婚后所得财产的归属、管理、
使用、收益、处分以及债务的清偿等方面的法律制度,夫妻财产制度是规范夫妻财产
关系的重要法律制度。目前普遍将夫妻财产制度归分类为法定财产制或者约定财产制
之中,所谓法定财产制既是本文要着重介绍的夫妻共同财产制。夫妻共同财产制是指
在配偶双方没有就夫妻财产作出约定,或者约定无效的情况下,依照法律而当然适用
的夫妻财产制度。
随着我国社会主义市场经济的发展,夫妻共同财产的类型日趋多样化、复杂化。
哪些财产属于夫妻共同所有、夫妻对共同所有的财产享有怎样的权利、应负担怎样的
义务,成为婚姻法必须明确的问题。而解决这些问题的前提,是对夫妻共同财产的范
围予以明确认定。另外,介于法律不能穷尽现实生活中夫妻共同财产类型的局限性,
本文试图通过对夫妻共同财产制度发展和演变过程的深入追探,针对婚姻法解释三存
在的问题,阐述一下本人的建议。本文共分为三部分:第一部分为夫妻共同财产制度
概述,介绍夫妻共同财产制的特征和渊源,通过与夫妻约定财产制的对比,发掘夫妻
共同财产制的优越性和不足。第二部分是夫妻共同财产的界定,通过对“婚姻关系存
续期间”及“夫妻所得共同财产”的两个概念进行界定,明确了应纳入夫妻共同财产
范围的婚姻关系存续期间所得及遵循规则。第三部分为我国夫妻共同财产制的现状与
完善,通过对《解释(三)》出台的背景和实施现状进行研究,提出本人一些浅见。

Abstract
Marital property system is known as marital property system, which is the legal
system about the ownership of the property, management, use, e and debts before
marriage and after marriage. The marital property system is an important legal system of
property between husband and wife. Currently the marital property system is classified as
the legal property and contractual property system. The legal property system introduced in
this paper is the matrimonial property system. Matrimonial property system refers to that
when the spouses did not stipulate the property of them, or the agreement is invalid
situation, the law about marital property system is applicable to matrimonial property
regime and of course.
With the development of our socialist market economy, the type of the joint property
of husband and wife are ing more diverse plex. What property belonging to
the husband and wife, what rights husband and wife enjoy about mon property
and how they burden obligations of debt
