---行政合理性原则

中文摘要
行政自由裁量权作为现代行政法的核心内容,是法律赋予行政机关的一项重要的行政权力。现代社会的发展,使行政机关享有的自由裁量权呈现不断扩大的趋势。行政自由裁量权的存在,一方面适应了现代社会飞速发展以及高效行政的需要,另一方面,实践中行政自由裁量权的滥用,又带来严重的负面效应和弊端。行政自由裁量权的适度、合理行使对法治有重要的促进和保障作用,但其膨胀和错位对依法行政构成了极大的威胁。如何对行政自由裁量权进行有效控制使其最大限度的服务于社会,成为现代行政法领域中一个非常重要的问题。本文通过对行政自由裁量权的概念、存在必要性的再认识,剖析了当前滥用行政自由裁量权的种种表现及其危害,分析了控制行政自由裁量权滥用应遵循的基本原则,初步探讨了控制行政自由裁量权的方法和途径。

Abstract
As the core content of modern administrative law, administrative discretion is an important power that authorized by law to the the development of modern society, the administrative discretion
presents a trend of expansion. The existence of the administrative discretion,on the one hand, meets the need of the development of modern society and the promotion of administrative efficiency; on the other hand ,the abuse of
the administrative discretion in prance will bring serious negative effect. If it was exercised properly and rationally, it would promote and gurantee the rule
of law, but its expansion and abuse will threaten the rule of law to control the administrative discretion effectively to make it serve the society best has e a very important question in modern administrative law area. The paper analyzes the presentation and damages of
the abuse of administrative discretion and probe into the way of control administrative discretion by reconsideration of the conception and necessity of administrative discretion.
