彩礼返还规则的法律研究

摘要
彩礼作为一种独特的文化现象存在于中国大地已几千年之久,是中国传统的一
种婚嫁风俗。随着社会的发展和时代的变迁,由彩礼所引发的纠纷也是层出不穷。
2004 年 4 月 1 日生效的最高人民法院《关于适用〈中华人民共和国婚姻法〉若干问
题的解释(二)》第 10 条为法官在司法实践中妥善处理彩礼纠纷提供了直接的法律依
据,有助于规范人民法院审理案件,从而使纠纷得到妥善的解决。但是,在司法解
释中没有对理论界争论的彩礼的法律属性进行全面的界定,同时彩礼返还规则在适
用中也是存在许多问题和不足之处,对于这些不足我们应该积极予以完善,这对于
社会的稳定和谐有着积极的意义。
全文由引言、正文和结语组成,正文分四个部分:
第一部分为彩礼的涵义和性质。通过这一部分我们可以了解到彩礼的概念和特
征,然后通过对国内关于彩礼性质不同学说的评析进一步明确彩礼的法律属性。
第二部分为彩礼返还规则在我国的适用。这一部分主要介绍了我国彩礼返还的
相关规则并给与评析,然后从实证案例分析的角度对彩礼返还规则在我国的适用进
行了思考。
第三部分为我国彩礼返还规则的不足。这一部分主要介绍了我国彩礼返还规则
在诉讼主体和诉讼时效的确定上、妇女和无过错方权益的保护上、共同生活的界定
上、对我国风俗****惯的照顾上以及返还方式的规定上都存在一定的不足之处。
第四部分为我国彩礼返还规则的完善建议。这以部分主要针对以上我国彩礼返
还规则的不足提出了相关的完善建议,比如:明确诉讼主体和诉讼时效、注重对妇
女和无过错方权益的保护、以时间作为彩礼返还的适用条件、以“酌情返还”为原
则、引入****惯制定规范意见等。

Abstract
Bride price as a unique cultural phenomenon exists in the land of China has
thousands of years, is a traditional Chinese wedding customs. With the development of
society and changing times, disputes arising from the bride price is also endless. April 1,
2004 entry into force of the Supreme People's Court "on the application <The People's
Republic of China Marriage Law> Interpretation of Several Issues (2)" section 10 of the
judges in the judicial practice of bride price to properly handle disputes the legal basis for
providing direct help to regulate people's court hearing the case, so that disputes are
properly resolved. However, there is no judicial interpretation on the price of debate on the
theory of the legal attributes of prehensive definition, while the return of bride price
rule is also applicable in many problems and inadequacies, we should be positive for these
deficiencies to be perfect, this for munity stability and harmony is of positive
significance.
