[内容摘要] 教唆犯是指故意唆使他人实施犯罪意图的犯罪分子。即自己并不亲自参加某种犯罪,而是以自己的言行去引起他人产生犯罪意图,通过他人去实施犯罪。目前理论界对教唆犯的认定有争议,是研究的热点。本文论述了教唆犯的概念性质及其成立条件,重点论述了教唆犯的犯罪停止形态,并对什么是教唆犯犯罪中的“着手”、“未得逞”、“意志以外的原因”做出分析及解释。期待对教唆犯有一个全面的认定。
