摘要
未成年人监护制度是我国对于对未成年人法律保护的基础性的重要制度。其指的是对于未成年人的人身、财产以及其他合法的权益进行监督和保护的一种民事法律制度。
本文笔者首先从未成年人监护制度的概念以及性质入手,对我国未成年人监护制度本身做了详细的介绍,包括对于监护人的确定、监护人的监护内容、监护人的责任承担等。后通过对于我国农村留守儿童的监护制度现状入手,对于农村留守儿童的监护制度中所存在的问题进行了分析,并从建议完善委托监护制度以及设立监护监督制度两点措施,对于制度中所存在的问题进行解决。
Abstract
As a fundamental system of the legal protection for the person who was under 18 years old, the guardianship system is vital. It is a kind of civil legal system of supervision and protection for children’s body rights, property rights and other legistimate rights and interests.
This paper first introduces the guardianship system itself by showing the concept and characters of the guardianship system in our country, including the person of the guardian, the specific things of the guardian and the responsibility of the guardian. Next, it shows the present situation of the guardianship system of the left-behind children and analysis the defects of it. At last, the paper shows two measures to develop it , such as to develop the entrusted guardianship system and build a system of supervision of the guardianship.
