文档介绍:苏州大学硕士学位论文论用人单位解除劳动合同的条件姓名:陈立生申请学位级别:硕士专业:法律·劳动法学指导教师:黄涧秋20100401论用人单位解除劳动合同的条件中文摘要1论用人单位解除劳动合同的条件中文摘要劳动合同是用人单位和劳动者签订的有关劳动权利和劳动义务的协议。劳动合同的解除是指劳动合同订立以后,尚未全部履行以前,由于某种原因导致劳动合同一方或者双方当事人提前消灭劳动关系的法律行为。劳动合同解除制度是劳动合同法乃至劳动法的重要组成部分之一,是劳动法的重大课题,长期倍受当事人和劳动立法、司法机关的关注。现行的《劳动合同法》规定的用人单位单方解除条件虽较之以前的规定更趋完善,但仍存在有待进一步解决的问题,如大多许可性条件的判断标准过于笼统和不可操作性、裁员标准缺乏科学合理性等。劳动合同解除直接影响到劳动者劳动权的实现,因而我国劳动法严格限制用人单位任意解除劳动合同,但实践中用人单位肆意解除劳动合同的情形却随处可见,严重破坏了和谐的劳动关系。本文采用比较方法,并综合运用了价值分析、实证的方法对用人单位解除制度进行了分析。作者在对我国现行解雇制度进行较为全面的总结思考和对国外解雇保护制度进行比较借鉴的基础上,在立法方面提出了一些建议,从而寻求司法补救措施,明确立法完善的方向。关键词:劳动合同;用人单位;解除条件;完善作者:陈立生指导教师:黄涧秋论用人单位解除劳动合同的条件中文摘要0On Conditions of the Terminating Labour Contracts by Employers Abstract The labour contract is an agreement signed between employers and employees concerning labour rights and obligations. Its termination is a legal action which is conducted due to certain reasons by one of the parties or both to eliminate labour relations in advance after the contract is concluded but has not been fully carried out. The system of termination of labour contracts is an important part of the labour contract law and even labour law to which it is also a great task, having been paid close attention by parties, labour legislative bodies and judicial departments. Although the conditions of termination of labour contracts, which is stipulated by current labour contract law, is ing more and more perfect than before, it still has some problems to be resolved. For instance, the criteria of most of the permissible conditions are too general and lack operability. Standards of employments and lay-offs are not scientific or rational. Termination of labor contract will have a direct impact on realization of employee’s labor rights. Thus, the termination of labor contract by employers is strictly limited by Chinese labor law. While in practice, there were many cases on terminating the labor contract by employer optionally. Then the harmonious labor relationships were seriously damaged. In this paper, comparison
