高校学生权利现状分析及保障对策研究
摘要
随着依法治国战略的实施和社会法治化进程的加快,依法行政、依法治校成为高等
教育改革与发展的根本要求。教育部于年月颁布新的《普通高等学校学生管理
规定》(以下简称新《规定》)和《高等学校学生行为准则》(以下简称新《准则》),新
《规定》中有关学生权利内容的强调和保障学生权利的程序性规则的进一步完善,是高
校学生权利得以维护和保障的法律依据,也是我国高校学生管理制度创新的新起点。
在高校管理实践中,一些原本存在的问题在近几年更加凸显出来,例如高等学校与
学生的法律关系问题,高校管理权力的来源及其合法性问题,高校学生管理过程中对学
生处罚分的合法性问题等等。这些问题恰恰与学生权利息息相关,都要求高校做出符
合新形势的制度回应,在依法治国的大背景下,学校法治的要求更为明显。
本论文通过文献、访谈、比较研究、案例分析等研究方法,从高校管理现状入手,
以事实为基础,分析事实背后的原因,并提出高校管理过程中对学生权利保障的政策性
建议。
本文以高校管理改革与学生权利保障的一致性为出发点,从高校管理的角度来深入
研究问题,落脚在学生权利的实现与保障体制的建立。本文通过高校管理过程中学生权
利保障的现状,分析其现象背后的原因,并提出利于保障学生权利的高校管理建议,包
括:建立新型校生关系,树立法治、服务理念;完善学生管理规范,明确学生权利内容;
规范程序制度建设,严格执行正当程序;建立权利参与途径,鼓励学生参与决策管理;
健全权力救济机制,完善校内申诉制度。

Actuality Analysis of Droit and Countermeasure Research for
Students in University
Abstract
Along with implementing country with law and the course e quick, managing school
with law is essential for reforming and developing advanced education. Ministry of education
put out new < the law for managing student mon advanced school> (following is
named new <law>) and <the behavior rule mon advanced school> ( following is
named new <rule>) in march 2005, The new <law> is much more perfect for stressing and
ensuring student’s right, which afford law warranting for vindicating and ensuring student’s
right. The new <law> also is new start for innovativing the system of student management
in advanced school.
In the course of managing advanced school, some primary existent problem is ing
distinct in recent years,for example,the law connection of advanced school and student, the
origin and validity of managing right of advanced school, the validity to punishing student in
advanced school, and so on. These problems closely correlate to student right, which need
