摘要:人们在筹议足球“黑哨”时,习惯把焦点落在“能否组成纳贿罪”上。其实,这只是在评价裁判员收受财物的行为;而马虎了裁判员吹黑哨的行为对法益的侵害与不法的组成。裁判员收受财物和吹黑哨是两个行为,它们区别侵吞了不同种法益,组成不同的罪名;对其该当区别定性,赌博默示录。然后数罪并罚。这样,即使对“裁判员参赌的黑哨”、“人情黑哨”、“受指使的黑哨”等不能定纳贿罪的情景,也能依据裁判员吹黑哨的行为所得罪的罪刑,判处相应的刑罚。
