中文摘要
在我国,以互联网信息为主要载体的信息产业起步较晚,然而其发展速度可
谓是一日千里。在其发展进程中,对网络隐私的侵权已成为突出的社会问题而受
到社会各界的关注。目前我国网络隐私权保护制度呈现出的不完善、责任主体缺
失等问题,使得其还不足以保证用户可以通过现行法律、法规和司法程序得到很
好的保护,这更加要求必须加强对网路隐私权问题的探索研究,积极推进网络隐
私权保护制度的建构,通过现实性调研、实验等方法并借鉴国外先进做法来推动
网络隐私权规制制度的完善、同时进行效度、信度检验以考察其实际效能。本文
从隐私权及网络隐私权的涵义入手,通过文献法、问卷法等具体方法全面阐述我
国法律对隐私权保护的现状及网络空间中个人隐私权遭受侵害的基本情况和特
征,并在此基础上通过考察并借鉴了国外较为成熟和先进的网络隐私权保护制
度,提出了构建和完善我国网络隐私权保护制度的建议。

Research on the Protection of the right to
Privacy on the
Abstract
The development of industry and the interrelated information industry sets
out lately ,whereas,it was developing very rapidly .However ,the infringement of
privacy on work has e a prominent social problem which had been
concerned by munity .At present, Privacy Protection System in China
is not enough to protect the interests of users with the existing laws,
regulations and judicial procedures .The condition demands China to perfect the legal
system to privacy and brings forward a new claim to the Privacy Protection
System .This paper starts with the meaning of privacy and privacy to
elaborate the status that the law in China protects privacy and the content that the
cyberspace privacy is suffered from trespass. At the same time,to research and learn
more mature and advanced privacy protection system from foreign countries ,
proposed to build and improve our Privacy Protection System.
