文档介绍：期货犯罪研究法学硕士论文摘要专业刑法学研究方向中国刑法与经济刑法作者姓名陈加指导教师刘宪权教授在我国期货投资已成为继证券和房地产之后的又一投资热点期货交易正以前所未有的态势蓬勃发展由于期货交易自身的特点它与期货犯罪有着天然的不解之缘各种期货市场莫不充斥着期货犯罪的痕迹但是期货犯罪问题研究在我国刑事立法理论和实践中都显得十分薄弱理论及实务界对此的关注程度也很不够期货犯罪在立法中存在的漏洞比比皆是反映到司法实践中很多严重期货违规行为得不到妥善的处理在很大程度上造成了对期货犯罪的打击不力这种立法滞后导致司法软弱的现象直接影响到期货交易及期货市场的健康发展期货犯罪的严重社会危害性和我国目前在这一领域研究的匮乏使笔者决定把其作为自己学位论文研究方向全文除引言外共分六章约48000字第一章大致介绍了期货交易的历史发展概况部分重要概念和期货交易的基本特征主要功能以及期货交易的基本流程同时对我国目前的期货交易法律保障体系作一介绍第二章主要是针对我国目前期货交易中的问题和期货市场的现状进行阐述包括部分期货交易违规重大案件的出现国家针对期货的违规操作而出台相关法规的立法轨迹以及目前期货交易中仍然普遍存在的违规操作现象第三章讨论的重点是目前我国期货交易违规违法行为的犯罪化问题以及针对期货违规现象刑罚权介入的必要性问题第四章针对刑法理论领域中对期货犯罪的刑事规制理论研究的薄弱性对期货犯罪本身在刑法学范畴内的相关问题作进一步的明确和界定包括期货犯罪的概念和构成要件分析第五章通过对已有的刑事立法中的期货犯罪的具体个罪的剖析并结合我国当前期货犯罪的特点对期货犯罪在法律适用的各个具体方面展开讨论第六章针对我国刑事法律规范体系中关于期货犯罪的立法缺陷及薄弱环节并结合西方发达国家日趋完备的期货犯罪立法实践发表一点自己的看法并提出初步的立法改善建议THE RESEARCH OF FUTURES CRIME(Abstract of Degree Thesis)MajorScience of Criminal LawResearch FieldCriminal Law of China & Economic Criminal LawAuthorAres ChenTutorProfessor Xianquan LiuIn China, futures investment has e another hot spotfollowing by the investment of bond and real estate. In terms of judicature practice, many serious behaviors which violate the futures regulations cannot be well solved,which impedes the attack on futures crime to a large kind of phenomenon that the delay of legislation leadsto the weakening of administration of justice directlyinfluences the healthy development of futures exchange and futures market.
